Synopsis
Landlord sought possession of the property after the tenant refused to sign a lease renewal beginning June 2016, and in response, the tenant counterclaimed, alleging overcharge damages. The court granted the tenant's counterclaim and dismissed the landlord's claim of action for possession, finding that the landlord had charged the tenant above the legal rent following an impermissible increase in rent of more than 300% in 2002.
