Synopsis
Landlord commenced a lease-expiration holdover proceeding. The court dismissed the petition sua sponte under CPLR § 409(b), finding the annexed Good Cause Eviction Law notice fatally contradictory: it simultaneously indicated the premises was not subject to GCEL and that it was, and that the landlord both was and was not offering a renewal lease. The irreconcilably contradictory notice failed to meet the baseline requirement of a clear, unambiguous predicate notice.
