Synopsis
In this holdover proceeding, the court dismissed the petition on traverse. Tenant moved for dismissal on grounds of defective service of process under RPAPL §735, asserting that service was not reasonably calculated to apprise tenant of the pendency of the proceedings, and also moved to disqualify petitioner's counsel under the advocate-as-witness rule. The court granted the traverse motion, finding service defective, and dismissed the petition for lack of personal jurisdiction.
