Synopsis
In this licensee holdover involving an OMH-regulated supportive housing community residence, landlord served a Notice to Quit based on tenant's discharge from the program, then subsequently executed a new Occupancy Fee Agreement with tenant. The court dismissed because landlord's execution of a new agreement after service of the predicate notice vitiated the Notice to Quit, rendering it a nullity. A landlord who renews an occupancy agreement after service of a termination notice cannot thereafter rely upon the prior notice as the basis for a summary proceeding.
