Synopsis
Court upheld HDC's determination denying successor tenant a rental subsidy administered by the Housing Assistance Corporation (HAC) pursuant to a 2001 class action settlement, distinguishing between succession to the tenancy (governed by statute and case law) and succession to the HAC subsidy (governed by the settlement contract). Because petitioner's mother had not continuously included her on annual income recertifications as required by the settlement, HDC's decision to deny the subsidy was rational.
