Synopsis
The tenant moved to dismiss the landlord's holdover proceeding, alleging a defective predicate notice and petition. The court denied the tenant's motion regarding the sufficiency of the alleged licensee relationship. However, the court granted dismissal without prejudice because the landlord's predicate notice asserted the premises were rent-stabilized and thus exempt from the Good Cause Eviction Law (GCEL), while the landlord's amended petition subsequently claimed the premises were rent-controlled. Citing that predicate notices cannot be amended and the regulatory status claims were contradictory, the court dismissed the proceeding.
