Synopsis
A landlord commenced a nonpayment proceeding alleging a written rental agreement for a rent-stabilized apartment. After defaulting and vacating the default, the tenant moved to dismiss, arguing no written lease was in effect for the period of alleged arrears. Despite conducting discovery, the landlord failed to produce the required written agreement. The court, noting that a written lease is mandatory for rent-stabilized apartments, granted the tenant's unopposed motion to dismiss the proceeding for the landlord's failure to establish a valid rental agreement.
