Synopsis
This nonpayment case was dismissed after the tenant moved to dismiss because the landlord failed to provide a written lease agreement between the parties. The landlord had commenced the proceeding alleging a written rental agreement and that the premises were subject to the Rent Stabilization Law. However, after discovery, no such written lease in effect at the commencement of the case could be produced, which is required for nonpayment proceedings involving Rent Stabilized apartments. Therefore, the tenant's motion to dismiss was granted.
