Synopsis
In a post-foreclosure holdover proceeding; the court denied the tenant's motion for pretrial discovery aimed at determining the landlord's status under the Good Cause Eviction Law (GCEL). The tenant sought to discover the landlord's real estate holdings to ascertain if GCEL protections applied. The court ruled that GCEL is inapplicable to holdover proceedings under RPAPL § 713 because such actions presume no landlord-tenant relationship exists; thus eliminating the tenant's "ample need" for disclosure. The landlord's cross-motion to amend the petition to reflect the omission of GCEL language was granted.
