Synopsis
In this holdover proceeding, the landlord alleged that the apartment was not subject to rent stabilization because it was a HUD-regulated project. However, the landlord conceded that a prior tenant held a rent-stabilized lease. The court granted the tenant's motion to dismiss the petition, finding that landlord failed to accurately plead the regulatory status of the apartment as required by RPAPL § 741.
