Synopsis
In this holdover proceeding, the landlord attempted to evict the tenant for failure to sign a renewal lease, citing a rent increase and the tenant’s non-purchase status in a co-op under the Martin Act. The court ruled the renewal lease offer invalid due to its retroactive start date, rendering the landlord’s notice to terminate was not sufficient under RPL §226-c and the case for eviction untenable. The case was dismissed as a result of the invalid lease offer and the failure to meet legal requirements.
