Synopsis

The landlord initiated a holdover proceeding against the tenant, alleging various acts of nuisance. The tenant requested a bill of particulars and, when that was denied, moved for discovery. The landlord argued that discovery was unnecessary in a summary proceeding and that the tenant should be aware of his own conduct. The court granted the tenant's motion in part, allowing discovery of specific information necessary to prepare a defense, while limiting the disclosure of the identities of complaining neighbors to those the landlord intends to call as witnesses.
