Synopsis
Landlord filed a nonpayment action against tenant, who had inherited a rent-stabilized lease from his late mother. Tenant moved to dismiss, arguing he had no rental agreement when the proceeding began and that the rent demand was flawed, including pre-lease arrears. The court dismissed the case, finding no valid rental agreement existed at filing and deeming the rent demand defective for including unpaid amounts predating tenant’s succession lease.
