Synopsis
The landlord, Department of Housing Preservation and Development (HPD), sought an order finding that the tenant, Juda Rosenfeld, committed harassment and awarding civil penalties. The tenant moved to dismiss the harassment claims, arguing that HPD lacked standing. The court held that HPD has the authority to bring harassment claims under Administrative Code § 27-2120 (a) and that harassment is a violation of the code. The court also found that HPD is not required to serve a notice of violation before commencing the proceeding.
