Synopsis
The court found the landlord illegally locked out the rent-stabilized tenant from her apartment after she visited her mother. The tenant credibly testified she had a lease, left belongings, and did not surrender keys. The landlord failed to prove surrender of possession. However, the court dismissed against the new tenant who legally obtained the apartment through HRA after the lockout. The court awarded a final judgment of possession to the tenant against the landlord but permanently stayed issuance of a warrant of eviction against the new tenant.
