Now, therefore, it is ORDERED that the Motion to Dismiss is granted in part, and it is further ORDERED AND ADJUDGED that the Complaint, as it relates to Plaintiffs Jullian Castillo, Jose Curet and John Platten, is dismissed as moot as they have been released under parole supervision, and it is further ORDERED AND ADJUDGED that the Complaint is dismissed with prejudice, except as stated below and it is further ORDERED AND ADJUDGED that 9 NYCRR § 8002.4 (e) is a valid exercise of Respondents rule-making authority and it is further ORDERED AND ADJUDGED that Respondents' policy to refuse to disclose the existence of victim's statements in Plaintiffs' parole files is arbitrary and capricious and an abuse of discretion.
