Motion Granted for Landlord
Winner
Landlord Substantially Won
Synopsis
In a licensee holdover, the tenant moved to dismiss on five grounds: religious marriage creating a support obligation; failure to name the landlord's legal wife and co-owner as a necessary party; defective predicate notice that labeled the occupant as both tenant and licensee interchangeably; incorrect zip code; and retaliatory eviction. The court denied the motion on all grounds. No support obligation or shared children established the familial exception; the co-owner was not a necessary party given her supporting affidavit; neither notice defect nor the errant zip code was material; and landlord articulated a non-retaliatory basis.
