Synopsis
In this nonpayment proceeding, tenant filed a post-eviction OSC. Though tenant lacked the reasonable excuse required under CPLR 5015(a)(1), the court grants the OSC under RPAPL § 749(3), which allows restoration to possession upon good cause shown. Good cause exists because arrears are low, HRA (through CityFHEPS) covers nearly all the rent, and the remaining balance will be covered by a CityFHEPS modification.
